the house only has a few scraggy bushes between us and next door and its new!!!If you buy a new house from a developer do they have to provide fencing to your gardens?

I think that they are obliged to provide a boundary line fence to establish clearly the property boundary lines, but this only needs to be upright posts and 2 or 3 strands of wire. There are more types of fence than decorative ones.
NOPE fencing is not required. You can ask that one be put it but it will most likely cost more.
They don't have to, but you might ask since the adjacent home isn't well maintained.

Unless it is part of your contract....they are not required to provide a fence.
If it's not on the plans/documents then no.
